Mural Acceptable Use Policy and Content Guidelines

This Acceptable Use Policy and Content Guidelines (“AUP”) applies to all who use or access the Services. Any capitalized terms that are not defined in this AUP have the meaning ascribed to such terms elsewhere in the “Agreement” (either the Terms of Service or Main Services Agreement, as applicable to each Customer).  

YOUR COMMITMENT

When you create or make available Content on or through the Services (including without limitation the Mural Community) or interact with other Authorized Users of the Services, you agree to comply with all of the following requirements.

RESPECT OUR RIGHTS AND OUR BUSINESS

Do not circumvent, disable or otherwise interfere with security-related features of the Services or any features that prevent or restrict use or copying or enforce limitations on use of the Services. Do not access the Services by any means other than through those that we provide to you, and do not sell or otherwise let others use your Mural account. Do not (and do not aid or permit any third party or Authorized User in any) attempt to do any of the following without our express written authorization: (a) copy or adapt any object code or attempt to reverse engineer or discover any source code that makes up the Services; (b) scrape, mine, or otherwise extract or copy any data, content, or materials from the Services (other than as a result of our Integrations, or standard search engine or Internet browser functionality); or (c) resell, lease, or otherwise provide any third party with access to the Services other than as expressly contemplated in our Agreement. Do not use our Services to create any application, integration, platform, or service that competes with the Services in whole or in part.

NO PROHIBITED OR HIGH RISK ACTIVITIES

The Services are not designed or intended to be used for any high risk activities or any regulated software, infrastructure, systems, or services. For example, and without limitation, do not use the Services for: performing financial transactions or services, such as payroll, accounting, payment processing, banking, or securities brokerage; storing or processing patient health records or medical records; supporting hazardous or mission-critical uses, or uses requiring fail-safe performance, such as the operation of nuclear facilities, aircraft navigation or communications systems, air traffic control systems, or weapons control systems; supporting any embargoed or sanctioned activities, entities, or individuals; or supporting any uses where system failure could lead to death, personal injury, or environmental damage.

CONTENT MUST BE YOUR OWN

You must have created your Content or otherwise have all necessary rights and/or permission to post your Content on the Services.  Do not post Content that violates our or any other person’s publicity rights, copyrights, other proprietary or intellectual property (IP) rights, or contractual rights. If you believe Content on the Services infringes your copyrights, please see our Copyright Policy.

If you believe any Content on the Services infringes or violates your other IP rights, right of publicity, or other proprietary rights, please send notice to our Designated Agent at copyright@mural.co. In your notice, please include all of the following:

  • Your full name and your electronic or physical signature.
  • Your contact information, including mailing address, telephone number and email address.
  • Identification of the material that you claim is infringing your exclusive rights and information reasonably sufficient to permit us to locate that material;
  • An explanation of the exclusive rights that you own/have and why you believe the material you have identified infringes/violates those rights, sufficient for us to evaluate your claim.

Upon receipt, we will evaluate your claims. We may ask you to provide additional information. Please also note that the information provided in any such notice may be forwarded to the applicable customer (if applicable). If a dispute develops as to the correct owner of the rights in question, we reserve the right to remove the Content in question pending resolution of the matter.

BE DECENT AND RESPECTFUL

When using the Services: do not make personal attacks on others, including Authorized Users, members of the Mural Community, and our employees;  do not use language or post, share or link to any content that is defamatory, damaging, disruptive, unlawful, inaccurate, pornographic, vulgar, indecent, obscene, lewd, lascivious, profane, hateful, threatening, exploitative, violent, bullying, harassing, or otherwise offensive or objectionable; do not use language or post, share or link to any content that incites, encourages or threatens immediate physical harm against any group or individual.

NO COMMERCIAL OR ADVERTISING USE

While the Services are meant to be used for business purposes, they are not an advertising medium. Do not post, share or link to any content that contains advertisements or solicits any person to buy or sell products or services. Recommending a product or service is OK so long as you disclose any material connection between you and the provider of such product or service. Do not use the Services for any “spammy” or other unauthorized purpose, including sending unsolicited or commercial emails, messages, comments or other communications, or collecting usernames and/or email addresses of other Authorized Users for such purposes.

DO NOT DAMAGE THE SERVICES OR ANYONE’S DEVICE(S)

You may not access or use the Services in any way that constitutes, contains, installs or attempts to install, or promotes spyware or other computer code that is designed to enable you or others to gather information about or monitor the online or other activities of another party or otherwise gain unauthorized access to another’s device(s). You may not interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services. You may not post, share or link to any content that constitutes, contains, installs or attempts to install, or promotes, malware or other computer code that is designed to cause a Security Incident or otherwise hack into the Services.

REPRESENT YOURSELF TRUTHFULLY

Do not impersonate any other person or entity. Do not provide false or misleading information.

KEEP PRIVATE INFORMATION PRIVATE

Remember that some aspects of the Services may be broadly visible to other Authorized Users and/or the general public. Do not post personal information (for example, never reveal your password, phone number, address, or similar information) in any forum on the Services that is public in nature.  Take care when determining whether to reveal your personal information to others. And do not reveal any personal information or private media of any other individual without their permission.

NO OBLIGATION TO MONITOR

We do not have any general obligation to monitor, and will not monitor, your Content or use of the Services for compliance with this AUP, our other Documentation or the Agreement. We do not have, and do not undertake, any obligation to prescreen, monitor, edit, or remove any Content, or to actively seek facts or circumstances indicating illegal activity. In accordance with applicable law, we reserve the right (but undertake no obligation) to, in our sole discretion and without notice or liability, take down or delete any Content, and to suspend or terminate access to and use of the Services by any person for violation of this AUP, our other Documentation, or the Agreement. You will provide reasonable cooperation in any investigation or action regarding suspected or alleged violations.

That information shall include information on any policies, procedures, measures and tools used for the purpose of content moderation, including algorithmic decision-making and human review, as well as the rules of procedure of their internal complaint handling system. It shall be set out in clear, plain, intelligible, user-friendly and unambiguous language, and shall be publicly available in an easily accessible and machine-readable format. 

CONTENT REPORTING AND EU DIGITAL SERVICES ACT

The European Union’s Digital Services Act (DSA) covers hosting services, including Mural. The DSA requires that hosting services remove reported content that violates policies or applicable law, among other obligations.

Mural was built for collaboration and we’re committed to maintaining Mural as a safe, trusted and productive work environment for our customers and users. Using Mural to store or share prohibited or illegal content violates our Terms and this AUP. When we are alerted to prohibited or illegal content being stored or shared on Mural, we will either directly remove that content consistent with applicable law and our terms and policies, or work with the applicable customer (as the data controller) to remove such content where we are the data processor and we do not have access to or the ability to remove such content.  Please note that we do not currently use any automated processing technologies as part of our review/moderation practices.

If you are located in the European Union and you believe there is illegal content on Mural, you can report it at the following link.  We will review reports and remove content that violates our policies or applicable law. 

If you are a user whose content has been removed on the basis of a report, we (or where we are a processor, the data controller) will provide you with an explanation for the removal. You will then have the ability to appeal the decision.  Information on how to appeal and the information to provide will be given in our notification to you.
